Non liquet
 
Diese altrömische Rechtsformel ist unter anderem in »Pro Cluentio«, einer Rede des römischen Schriftstellers und Politikers Cicero (106-43 v. Chr.), belegt. Sie bedeutet übersetzt »es ist nicht klar« und war die Formel der altrömischen Geschworenen oder des Richters, mit der zum Ausdruck gebracht wurde, dass nicht entschieden werden kann, ob Schuld oder Nichtschuld vorliegt. Auch im heutigen Zivilrecht hat non liquet die Bedeutung einer Feststellung darüber, dass ein Sachverhalt unklar geblieben ist, besonders dass für eine Behauptung weder Beweis noch Gegenbeweis geführt worden ist.
